These Terms of Service ("Terms") are a legal agreement between you and Ken Milstone-Turner, operating as Carnate ("Carnate," "we," "us," or "our"), located in Toronto, Ontario, Canada. They govern your access to and use of the Carnate mobile application, website at carnate.app, and all related services (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years of age to create an account or use the Service. By creating an account, you represent and warrant that you are at least 13 years old. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.
We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete that information promptly.
To use most features of the Service, you must create an account using Apple Sign-In, Google Sign-In, or email and password. You agree to:
You may not create an account on behalf of someone else, use another person's account, or create multiple accounts for deceptive purposes.
You retain ownership of all content you submit, post, or display through the Service, including photos, text, captions, comments, and vehicle information ("Your Content"). These Terms do not transfer ownership of Your Content to Carnate.
By posting Your Content on the Service, you grant Carnate a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and create derivative works from Your Content, in connection with operating and providing the Service. What we will NOT do: We will not sell Your Content to third parties. We will not use Your Content in paid advertisements without your separate, explicit consent. This license continues for as long as Your Content is on the Service. If you delete specific content, the license for that content ends, subject to a reasonable period for cached or archived copies to be removed from our systems.
You represent and warrant that you own Your Content or have the necessary rights and permissions to post it, Your Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party, and Your Content complies with these Terms and all applicable laws.
The Service, including its design, code, logos, trademarks, text, graphics, and all other materials created by Carnate ("Carnate Content"), is owned by Carnate and protected by intellectual property laws.
Carnate pulls vehicle information from third-party sources, including public auction platforms and government vehicle databases. This content is labeled with its source. Imported content is provided for informational purposes and is subject to the accuracy disclaimer in Section 12.
You agree not to use the Service to post illegal, threatening, defamatory, obscene, or otherwise objectionable content; harass, bully, intimidate, or threaten other users; impersonate any person or entity; create fake accounts or use bots; post spam or unsolicited promotions; manipulate engagement metrics; post intentionally false vehicle information; access the Service through unauthorized automated means; reverse-engineer the Service; or collect user data without consent.
Carnate reserves the right to remove content and suspend or terminate accounts that violate these Terms.
Carnate respects intellectual property rights and complies with the DMCA. Copyright claims can be submitted to legal@carnate.app. For Canadian claims, Carnate follows the notice-and-notice regime under Canada's Copyright Act.
Carnate may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the app's Settings.
Vehicle information is provided on an "as-is" basis for informational purposes only. Carnate does not guarantee accuracy of VIN data, auction results, odometer readings, or plate lookup results. Do not rely on this information as a substitute for professional inspections or official records.
The Service may contain links to third-party websites. Carnate is not responsible for their content or practices.
When you delete your account, your profile information is permanently deleted. Posts and comments are retained in de-identified form as part of the permanent vehicle history record.
Material changes will be communicated with at least 14 days notice. Continued use after the notice period constitutes acceptance.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND.
You agree to defend, indemnify, and hold harmless Carnate from claims arising from your use of the Service, Your Content, or your violation of these Terms.
CARNATE'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF CAD $100 OR THE AMOUNT YOU PAID TO CARNATE IN THE PRECEDING 12 MONTHS.
Disputes shall be resolved by binding arbitration in Toronto, Ontario, Canada. Class action waiver applies.
These Terms are governed by the laws of Ontario and federal laws of Canada.
These Terms and the Privacy Policy constitute the entire agreement. If any provision is unenforceable, it will be modified to the minimum extent necessary.
